The Legal Way of Resolving the SA Land Issue

Black people should accept and comply with the calls of the Constitution of South Africa when they’re resolving the land issue. South Africans are fully aware of how the land was stolen from Blacks,Coloreds,Khoisans and Indians.

 

The land issue should be approached in a way which will not flout constitutional rights of the people. The land expropriation without compensation is a gross flouting of such rights which our supreme law protects.

 
The Section 25 of the Bill of Rights,states, in subs(2),that Property may be expropriated only in terms of law of general application…(a)for a public purpose/in the public interest and (b) subject to compensation,the amount of which&the time&manner of payment of which have either been agreed to by those affected or decided or approved by a court.

 

Therefore,by calling for expropriation without compensation,black people effectively claim that they are determined to break the supreme law. The courts cannot intentionally flout constitutional rights of people by agreeing to land grabs which some blacks are advocating for.

We cannot resolve the land issue by which was done to blacks.Solving a problem by a problem causes more problems. We seek to duck them. Our approach to the land issue is clear:the govt has to use its own land for redistribution/restitution.

 

The govt should buy INFERTILE land through the Land Reform policy.We cannot build houses on fertile land while food security is unstable. The land issue should be approached with the willing buyer/seller model.We must pay for the land if we want it.

 

The fact that it was stolen from blacks doesn’t make us eligible to expropriate it without compensation under our supreme law.We’re prohibited. As the GDP is a subscriber to the SA supreme law,we will fight to protect the land from expropriation without compensation.

 

Those who think the GDP is a party of white racists,should know that their land issue approach is against the supreme law of this country.We are not trying to please certain races by protecting the constitutional rights of South African people.The law must be respected.As a political party with the interests of South Africans at its heart,we will uphold our supreme law until the end of time.
